Copyrights and patents and trademarks, oh my!

We’re a few days late on this one. It was the weekend, okay? Kids to entertain, houses to clean. Moms’ work is never done.

Speaking of moms, TwilightMOMS (they have a website and they sell Twilight-inspired stuff?) had themselves a spectacular tantrum on Twitter this Thursday. Someone was trying to make money off their good name!!!1!

The alleged perpetrator, “Twilight Moms Club: TWI-MOMS,” has been on Facebook since June of last year. Their plot outline on Facebook reads:


For several months, they were on Twitter as @Twilight_Moms. The TwilightMOMS website, however, used the Twitter name @TwilightMOMS, so you already know this is going to end in tears. Because of @TwilightMOMS’ tantrum, @Twilight_Moms has since changed their Twitter to @Twimoms_Club.

It might help you keep things straight if you remember TwilightMOMS as the one YELLING.

It was all well and good when the new group, @Twilight_Moms, just wanted to hang around and talk about Twilight, but then they decided to go for the big bucks, namely selling T-shirts for Child Abuse Prevention Month. Because there could be no reason for using “moms” in a fundraiser about child abuse prevention other than to capitalise on TwilightMOMS’ fame, right?

@Twilight_Lexicon, who had never previously taken notice of @Twilight_Moms despite all the retweets the _Moms gave them this last month (which was as far back as we went), immediately sent up an emergency flare to the FOR REALZ @TwilightMOMS. Then proceeded to bloviate on the subject for the next 10 tweets:

Sorry. 😦 We told you we were fat lazy moos.

…Oh, you meant the _Moms. Erm…right. Carry on.

I’d be majorly POed if someone tried to start a twitter called @twilight_lexicon no matter what their reason.

It’s not fair to the originating group, the work they put in to start their organization, and the image they want to support.

Kudos to original @TwilightMOMS (whose name I believe is trademarked so copycats beware!) No matter what the cause name imitation not cool

I’ve seen at least three groups in the last 30 days try to claim they are some version of @TwilightMOMS.

I applaude raising money for charity, but not using a variation on someone else’s well known name to do it.

@StephZarecki Beauty of trademark is that it covers things like this. i can just file a TOS violation if it ever happens

To clarify @TwilightMOMS is the legit group we’ve known for years, anything else is NOT the same group, and is NOT connected in any way

Anything being retweeted w/ a highly similar name is not THE @twilightmoms , ripping off their name no matter how worthy your cause not cool

TwilightMOMS claims their name is trademarked. We can’t find that specific name on TESS (doesn’t mean it isn’t out there, but it made us giggle anyway), but an owner search on the company Twilight Moms LLC brings up two Twilight MOM trademarks for clothing and jewelry and one for “Team Alice.” So tread carefully or you might get sued by the rightful owner. Which is not Summit.

Anyway, TwilightMOMS was on a field trip with her daughter’s class (thanks for telling us), but when she got home, the tantrum commenced:

Then there was this block of tweets from @Twilight_Moms (their name had already changed to @Twimoms_Club when we caught it) which is much easier to cap than link one by one, though remember this feed would have been interspersed with responses from @TwilightMOMS.

      That was a good question though, because she could have registered it and still got in trouble. They said B&BW registered “Twilight Woods” and is still getting sued by Summit, but I don’t think anyone “owns” Twilight as a word, so…

      Well from what I can gather and I maybe wrong you’ve got two twilight moms.
      The original twilight moms (I feel ridiculous even typing those words) kicked up a stink because they saw the second newer group as infringing on their so called ‘copyrighted’ name. Both the original group and twilight lexicon (who bought it to their attention) hadn’t bought the issue up until the newer group attempted to sell t-shirts in aid of a child abuse charity. Original twimom pissed that people may buy something in aid of a charity rather than the crap she sells so starts kicking up a stink on twitter. Basically some sad middle aged women with nothing better to do with their time behaving like children ‘cos another group have a similar name, lol. God help society if these people are actually raising children.

    Okay, I went to the website with all the merchandise. How can they sell that? They use the name “Snuggie”, um, last I checked Snuggie didn’t make a TwilightMom Snuggie..Snuggie is trademarked! Sounds like a case of pot meeting kettle. I wish I could ship these people off to an Island.

    It’s just one LOL after another in this fandom isn’t it?! I checked with the US copyright ofice- you can search for anything copyrighted on their site—guess what, “TWI_MOMS, TwilightMoms” etc are not listed…hmmm I wonder if it’s because
    A) they are full of shit
    B) they are dumber than a bag of hair
    C) have no idea what the fuck they are even talking about
    D) Can’t copyright something already copyrighted (i.e TWILIGHT)
    E) All of the above.

    So if I’ve got this straight the original twi moms and lexicon were harassing twi moms2 for using their ‘copyrighted’ name for raising money for abused children? Wow they sound like lovely people. I completely agree that if it’s a choice between a stupid twitter name/website or protecting young vulnerable children, the twitter/website should totally take priority. Can I suggest that these mothers focus on more important things like hmmmmmmmm perhaps bringing up their children, instead of wasting valuable time on waging war on twitter sites. Ladies put the book aimed at teenage girls down and grow the fuck up. It’s one thing reading YA lit it’s quite another when you start behaving like a teenager yourself.

      They’re more interested in having fun than taking care of their kids. I know one who tweets just about every five minutes all day long, and she has a newborn. As for waging war online, I wonder if when their kid comes home from school and says, Mom, someone called me fat, they say “Well, just go on Twitter and tell everyone she has VD!” Do they raise their kids to act as immature as they do?

    If she didn’t register that trademark, she’s shit outta luck. But also, my brother-in-law owns a small accounting firm named after himself. He asked at the time what would happen if someone else wanted to name their business “Smith’s”, and his lawyer said registered trademarks are given first come first serve in a geographic area. I don’t know if that’s city, state, region, or whatever, but it didn’t sound like if he named it “Smith’s” then no one else in the whole country could ever name a business “Smith’s.” I think this crazy lady needs to get over herself.

    Sometimes, not often, someone will do something shady and say “but it’s for CHARITY!” as if that excuses it. So I didn’t want to comment on that part, but really TwilightMOMS? They used a similar name to yours for months and you didn’t care, and ignored their emails, but suddenly they want to help abused kids and it’s dangerous to the “integrity” of your name?

    Good luck when Meyer or her publishers or Summit say you’re damaging the integrity of their series.

    Reading her tweets, it’s like she thinks that registering her “business” automatically made the name trademarked. Then she talks about copyrighting, so I don’t think sh eknows one from the other.

    I can’t believe anyone would be this overbearing when she’s on such thin ice with what she’s selling. Maybe she has some special permission we don’t know about, but you’d think she’d have said so by now. Sounds like she’s taking the Omnific tack and saying it’s all derivative.

    I was at a MOMS event in Salt Lake when the first FGB started. The head mom Lisa was there bitching about it saying fgb was taking away from their work with The lemonade people

    They went on the website and complained. They also went to SM summit and lb to get fgb blocked from being allowed to raise money causing s ton of shit for fgb. It’s all heresy except for the site. That was up for a few days before it was deleted.

    It wasn’t pretty but someone from fgb should probably comment further

    And that’s how Mormons act? It shameful.
